I firmly believe that the entire debate over gay marriage has really identified the wrong issue and has shown how feeling that there is always a need for government regulation has really infiltrated our society. We are asking the wrong question when we say should the government let gay people get married or not? What we should be asking is: why the hell is the government involved in the business of love and marriage in the first place?

Yes I understand the historical connections between marriage, procreation, society and the government, and yes I recognize that there are legitimate reasons for the government to overlook unions such as immigration, healthcare, taxes, inheritance etc., but the problem with that right now is that marriage is such a religiously loaded word and a fundamentally religious concept that it is always going to be messy for a secular government to be involved in that.

So here is the solution: Instead of going to get the court house to get a marriage license from the government, you now go to get a civil union license. Everyone gets the same license regardless of gender and everyone’s eligible for the same benefits. Then if you want to go get a marriage in a religious sense then you have every right to. Every church can decide for themselves what they want to consider a legitimate marriage, so the conservative right gets to conserve their concept of marriage, and gay people get their legal rights, its a win win situation.

So TL;DR: Deregulate marriage, everyone win. Hot Piece go make me a sandwich.

DOMA is unconstitutional. The federal government has no authority to define what marriage is. That is something that should be left to the states. Thats why I feel that prop 8 should be upheld. Personally I feel that we should disestablish marriage as a state institution entirely and replace it with a civil union. That way you separate the secular interests of the state from the religious implications of the term marriage that makes many people disagree with gay marriage. Everybody gets a civil union from the government and then of if you want to go get married in a church and that church approves of your union then thats cool to.
